Booking Terms and Conditions

Please read these Booking Terms and Conditions carefully before You complete any transactions via the Website, as these “Booking Terms and Conditions” will apply to Your transaction.

We recommend that You print a copy of these Booking Terms and Conditions for future reference.

1) Defined Terms

For ease of reference the following terms shall having the following meanings in these Booking Terms and Conditions:
“Customer”, “You” and “Your” means You, the purchaser of any Services;
“We” and “Us” means The Indigo Spa (Pty) Ltd.
“Dated Booking” means a booking for a specific time/date for the provision of spa treatments with The Indigo Spa (Pty) Ltd.

2) Introduction and relationship between You and Us

This Website is operated by Us, The Indigo Spa(Pty) Ltd a private company registered in South Africa , registration number K2015/135148/07. We are located at 3 Forssman Close, Barbeque Downs, Kyalami, Johannesburg, South Africa.
The Website allows You to book and pay for dated bookings which include spa and beauty services.

3) Dated Booking Payment Terms

Full 100% payment is due to confirm Your dated booking.

Dated bookings can be made in the following ways:

a) Sending a booking enquiry
Our bookings consultant will contact You via email or telephonically to finalise Your preferred date and time. Banking details will be emailed to You for EFT payment. 

b) Online Dated Booking
You can book and pay on our site for Your dated booking. Our online payment portal is operated by a third party payment provider, Pay Fast (Pty) Ltd, registration number 2007/011558/07.

Once Your payment has been received, We will send You a confirmation of Your dated booking via email.

4) Refunds , Rescheduling, late arrivals and no shows

For “Dated bookings purchased”:

No refunds will be processed.
Rescheduling of Your dated booking is permitted up to 48 hours prior to Your appointment.
Rescheduling of Your dated booking within 24 hours of Your appointment will attract a R 250 rescheduling fee.
Late arrivals will result in reduced treatment time. Please arrive 10 mins earlier to allow for changing and completion of client forms.
No shows for dated bookings will result in 100% forfeiture. No refunds will be processed.

for “Products purchased”:

Our goal is to ensure that you are the happiest customer at all times, however, in the event that your product is defective or damaged, you may return it to us for a replacement item. No refunds will be processed

Damaged or defective purchases must be returned within 7 days of delivery

Please keep in mind that for hygiene reasons, we cannot accept returns if the products have been opened – all tamper seals, and original packaging needs to be intact and in its original condition.

The items are your responsibility until they arrive back with us.

All return costs are for your own account.

5) Spa Etiquette

Please switch off all cell phones during treatments. Please keep noise to a minimal as there will be other guests at the spa.
We do not tolerate any sexual harassment or aggressive behaviour towards our staff. Our therapists will have the right to stop Your treatment if deemed necessary.
No smoking is allowed in the spa.

6) Liability

You agree that You will participate in all treatments at the Indigo Spa (Pty) Ltd entirely at Your own risk and will indemnify The Indigo Spa (Pty) Ltd and its management and staff from any injury, disease, death, damage or personal loss You may experience. We have implemented administrative, technical and physical controls that are designed to reasonably safeguard Your personal data. We however will not be held liable for any losses arising from data breaches.
By transacting on the Pay Fast online payment platform , You agree to their terms and conditions of Use. We will not be help liable for any losses experienced due to credit card fraud. You can read more information about the Pay Fast security features on https://www.payfast.co.za/security-fraud

7) Privacy Policy

Your private information is required for making a dated booking or sending a booking enquiry on the website so that We can verify You as a Customer. This information will be kept in the strictest confidence by Us and will not be sold or made known to third parties.

We may electronically collect, store and Use Your:

  1. name and surname;
  2. e-mail address;
  3. address

This information will be Used to :

  1. Contact You regarding Your dated booking and provide You a booking confirmation
  2. Subject to Your consent, to inform You about our special promotions.

Security of Personal Data

We process data mainly in electronic form in line with the Applicable Privacy Practices security requirements; The Indigo Spa has implemented an information security program that contains administrative, technical and physical controls that are designed to reasonably safeguard your personal data, including industry-standard encryption technology.

Retention of Personal Data and Your Rights in relation to Personal Data

We will retain your personal data for as long as necessary to perform our contractual obligations to you and as required by applicable law. Please note that while we are ready to assist you, we cannot always delete records of past interactions and transactions. For example, we are required to retain records relating to previous purchases for financial reporting and compliance reasons.

8) Our right to vary these Booking Terms and Conditions

We may revise these Booking Terms and Conditions from time to time in the following circumstances:
if We change the process for accepting payment from You;
if there are changes in relevant laws and regulatory requirements; and/or
if there are any other changes to our business that reasonably means We need to amend these Booking Terms and Conditions.
Every time You purchase a dated booking via our Website, the Booking Terms and Conditions in force at that time (and available for view on the Website) will apply to the Booking Contract between You and Us.
